Terms and Conditions for Partner Listings

These Terms and Conditions govern the purchase and use of a CraveLess.Me Partner Listing by clinics, counselors, programs, therapists, pharmacies, addiction support centers, hypnotherapists, acupuncture clinics, and other smoking cessation support providers.

1. Introduction

These Terms and Conditions govern the purchase and use of a CraveLess.Me Partner Listing by clinics, counselors, programs, therapists, pharmacies, addiction support centers, hypnotherapists, acupuncture clinics, and other smoking cessation support providers. By purchasing, submitting, or requesting publication of a Partner Listing, the partner provider agrees to these Terms and Conditions.

Definitions

For the purposes of these Terms and Conditions: - Partner provider means the clinic, counselor, therapist, program, pharmacy, support center, practitioner, organization, or other provider purchasing, submitting, or requesting a Partner Listing. - Partner Listing means a paid provider listing in the CraveLess.Me quit-smoking support directory, app, or related product experience. - Promoted Placement means a Partner Listing or support prompt that may receive additional visibility in the directory, app, or in-app pop-ups. - User means a person using CraveLess.Me or viewing the quit-smoking support directory. - Directory means the CraveLess.Me quit-smoking support directory. - In-app pop-up or support prompt means an in-app message that may show a relevant Partner Listing or support option to a user.

2. About CraveLess.Me

CraveLess.Me is a digital product designed to help users reduce or quit smoking through planning, progress tracking, and supportive tools. CraveLess.Me may also provide users with access to a quit-smoking support directory and in-app support options where relevant providers can be discovered.

3. Partner Listing service

A Partner Listing is a paid listing that may make a partner provider visible in the CraveLess.Me quit-smoking support directory and, where applicable, inside the CraveLess.Me app as a relevant support option. A Partner Listing, Promoted Placement, in-app pop-up, or support prompt may be labelled as Partner, Promoted, Sponsored, Listed provider, or similar wording to make clear that the placement is paid or commercial in nature. Publication of a Partner Listing does not mean that CraveLess.Me recommends, certifies, guarantees, medically endorses, or verifies the partner provider or the partner provider’s services. A Partner Listing may include: - Provider or clinic name - Short description of the service - Location, service area, or online availability - Website, email, phone number, booking link, or other contact details - Images, logo, or other visual materials - Category, country, and city placement - Contact form or other method for users to contact the provider - Optional offer or note for CraveLess.Me users The exact presentation, placement, and format of the Partner Listing may vary depending on the CraveLess.Me product design, directory structure, app experience, and technical requirements.

In-app pop-ups and privacy-friendly targeting

Where applicable, Partner Listings may be shown as in-app pop-ups or support prompts to users who appear to be slipping from their quit or reduction schedule, such as when the user’s logged progress indicates slippage from their plan. To protect user privacy, CraveLess.Me limits this targeting to basic contextual signals: the user’s schedule slippage and the country selected or provided when the user signed up. CraveLess.Me does not use broader personal profiling, sensitive personal information, browsing history, or unrelated behavioral data to personalize Partner Listing pop-ups. These pop-ups are intended to show relevant support options at moments when users may need extra help, while keeping personalization limited and privacy-conscious.

4. No guarantee of leads, clients, or results

The purpose of the Partner Listing is to provide relevant visibility to users who may be interested in quit-smoking support. CraveLess.Me does not guarantee: - Any specific number of views, clicks, contacts, inquiries, bookings, leads, clients, or sales - Any specific ranking, position, or frequency of display - Any specific user action after viewing a Partner Listing - Any specific commercial result for the partner provider The Partner Listing is a visibility and information placement service, not a lead-generation guarantee.

5. Partner responsibilities

The partner provider is responsible for ensuring that all submitted information is accurate, lawful, current, and not misleading. The partner provider must ensure that: - They are legally allowed to provide the services they describe - Any qualifications, licenses, certifications, claims, or professional statements are accurate - Contact details and website links are valid and up to date - Images, logos, and other materials are owned by the provider or properly licensed for use - Their listing does not contain false, deceptive, offensive, unlawful, or infringing content - Their services comply with applicable laws, healthcare rules, advertising standards, and professional obligations The partner provider must not claim guaranteed quit-smoking results, medical outcomes, success rates, cures, or treatment benefits unless those claims are accurate, evidence-based, lawful, and permitted under applicable advertising, healthcare, and professional rules. CraveLess.Me may request reasonable proof of the partner provider’s business registration, professional license, certification, insurance, authority to provide the advertised service, or right to use submitted materials. If the partner provider does not provide requested proof, CraveLess.Me may reject, suspend, or remove the Partner Listing. The partner provider must promptly notify CraveLess.Me if any listing information needs to be corrected, removed, or updated.

6. Healthcare and professional services

CraveLess.Me does not provide medical advice, diagnosis, treatment, counseling, therapy, or healthcare services through Partner Listings. Partner providers are independent third parties. CraveLess.Me does not verify, endorse, supervise, employ, or control partner providers unless explicitly stated otherwise. Users are responsible for deciding whether to contact or use a partner provider. Partner providers are responsible for their own professional services, communications, advice, treatment, programs, and outcomes.

7. Review and approval

CraveLess.Me may review submitted listing materials before publication. CraveLess.Me reserves the right to reject, edit, request changes to, suspend, or remove a Partner Listing if: - The listing appears inaccurate, misleading, incomplete, or unsuitable - The listing may violate applicable laws, platform rules, advertising standards, or professional rules - The listing contains inappropriate, offensive, or low-quality content - The partner provider does not respond to reasonable update or verification requests - CraveLess.Me determines that the listing is not aligned with the purpose of the directory or app CraveLess.Me is not required to publish every submitted listing.

8. Listing period and fees

Unless otherwise agreed, the Partner Listing is offered for a yearly fee. The early partner price is €9.99 per year unless a different price is shown at checkout or agreed in writing. This first-year discount is offered because CraveLess.Me is an early-stage app. The product, partner directory, in-app placement experience, and user base are still being built, and it may take time for usage numbers and partner visibility to grow. The discounted first-year price reflects this early-stage status and gives early partners a low-risk way to participate while the solution develops. Prices may exclude VAT, sales tax, or other applicable taxes unless clearly stated otherwise. The final payable price, including any applicable taxes or charges, should be shown at checkout. The listing period begins when payment is completed and the listing is approved or published, unless otherwise stated. Fees are charged for the listing period and are not based on performance, number of contacts, or number of users reached.

9. Payment

Payment must be completed through the payment method or checkout process provided by CraveLess.Me. The partner provider is responsible for providing accurate billing information and paying all applicable fees, taxes, and charges. CraveLess.Me may suspend or remove a Partner Listing if payment fails, is reversed, is disputed, or is not completed.

10. Renewals

Unless otherwise stated during checkout, Partner Listings do not automatically renew. If automatic renewal is offered or enabled in the future, it will be clearly stated during checkout or in the relevant order terms. If renewal is available, CraveLess.Me may contact the partner provider before or after the listing period ends with renewal options. If the partner provider does not renew, CraveLess.Me may remove, downgrade, or archive the Partner Listing after the listing period ends.

11. Refunds and cancellations

The partner provider may request cancellation of the Partner Listing at any time. Unless required by applicable law or agreed otherwise in writing, fees already paid are non-refundable once the listing has been reviewed, prepared, approved, or published. If a Partner Listing is suspended or removed because the partner provider breached these Terms and Conditions, the partner provider is not entitled to a refund unless required by applicable law. CraveLess.Me may provide a refund, partial refund, credit, or other resolution at its discretion if a technical or administrative issue prevents publication for a significant period.

12. Changes to the listing

The partner provider may request reasonable updates to their listing information, such as corrections to contact details, description, location, images, or links. CraveLess.Me may choose how and when updates are processed. Updates may be subject to review before publication. CraveLess.Me may make minor formatting, grammar, style, or layout edits to listing materials to fit the directory or app experience, provided the meaning of the submitted information is not materially changed.

13. Use of submitted materials

By submitting text, images, logos, descriptions, links, or other materials, the partner provider grants CraveLess.Me a non-exclusive, worldwide, royalty-free right to use, reproduce, display, format, edit, and publish those materials for the purpose of creating, displaying, promoting, and operating the Partner Listing. The partner provider confirms that they have the necessary rights and permissions to grant this use. The partner provider retains ownership of their own materials.

14. User contacts and communications

If users contact the partner provider through a listing, contact form, email, phone number, booking link, or website, the partner provider is responsible for handling those communications. The partner provider must comply with applicable privacy, data protection, healthcare, marketing, and professional rules when communicating with users. CraveLess.Me is not responsible for the partner provider’s follow-up, availability, response time, advice, treatment, services, or relationship with users.

15. Privacy and data protection

CraveLess.Me may process partner provider information for purposes such as listing creation, billing, support, communication, fraud prevention, and service operation. If a contact form or similar feature is provided, CraveLess.Me may process user-submitted information as needed to transmit the inquiry to the partner provider. Partner providers only receive user contact information when the user intentionally submits it or chooses to contact the partner provider, for example through a contact form, email link, phone call, booking link, website visit, or other direct action. If CraveLess.Me forwards a user inquiry to the partner provider, CraveLess.Me acts only to transmit the inquiry. After receiving the inquiry, the partner provider is responsible for handling the user’s information lawfully, securely, and only for appropriate follow-up related to the user’s request. The partner provider must not use user inquiries for unrelated marketing, spam, resale, profiling, or other purposes unless the user has clearly consented and the use is permitted by applicable law. If CraveLess.Me provides listing statistics, analytics, or reporting, those statistics may be approximate, limited, delayed, or unavailable. Unless a user directly contacts the partner provider or consents otherwise, analytics shared with partner providers will be aggregate or non-identifying and will not include personally identifiable user data. Each party is responsible for complying with applicable data protection and privacy laws that apply to their own activities. A separate privacy policy may explain how CraveLess.Me collects, uses, stores, and protects personal data.

16. Prohibited content and conduct

The partner provider must not submit or use the Partner Listing for: - False, misleading, or unverifiable claims - Illegal services or activities - Discriminatory, hateful, offensive, or harmful content - Content that infringes intellectual property rights - Spam, scams, phishing, malware, or deceptive links - Medical or therapeutic claims that are not legally permitted - Any content that could damage the trust, safety, or reputation of CraveLess.Me or its users

17. Availability and changes to the service

CraveLess.Me may modify, improve, suspend, or discontinue parts of the directory, app, Partner Listing format, placement rules, pricing, or related features. CraveLess.Me will make reasonable efforts to maintain the Partner Listing service, but does not guarantee uninterrupted availability or error-free operation. Temporary interruptions, technical issues, maintenance, design changes, or product updates do not automatically entitle the partner provider to a refund or extension unless required by law or agreed in writing. Because CraveLess.Me is an early-stage app, the partner provider acknowledges that features, placement formats, directory structure, pop-up rules, analytics, and user traffic may change over time. Directory and app usage may be limited at first and may take time to grow.

18. Limitation of liability

To the maximum extent permitted by applicable law, CraveLess.Me is not liable for indirect, incidental, special, consequential, punitive, or loss-of-profit damages arising from or related to the Partner Listing. CraveLess.Me is not responsible for: - The partner provider’s services, advice, treatment, claims, communications, or outcomes - User decisions, actions, or non-actions - Third-party websites, booking tools, payment systems, or communication platforms - Losses caused by inaccurate information submitted by the partner provider Where liability cannot be excluded, CraveLess.Me’s total liability is limited to the amount paid by the partner provider for the current listing period, unless applicable law requires otherwise.

19. Indemnity

The partner provider agrees to indemnify and hold CraveLess.Me harmless from claims, damages, losses, liabilities, costs, and expenses arising from: - The partner provider’s submitted materials - The partner provider’s services, advice, treatment, or communications - Inaccurate, misleading, unlawful, or infringing listing content - Breach of these Terms and Conditions - Violation of applicable laws, regulations, professional rules, or third-party rights

20. Termination

CraveLess.Me may suspend or terminate a Partner Listing if the partner provider breaches these Terms and Conditions, fails to pay applicable fees, submits unsuitable content, or acts in a way that may harm CraveLess.Me, users, or the integrity of the directory. The partner provider may request removal of their listing by contacting CraveLess.Me. After termination or expiry, CraveLess.Me may remove the Partner Listing from public display. Termination does not affect any rights or obligations that should reasonably continue after the listing ends, including payment obligations, use of submitted materials already published before removal, privacy obligations, limitation of liability, and indemnity.

21. Changes to these Terms and Conditions

CraveLess.Me may update these Terms and Conditions from time to time. If changes materially affect active Partner Listings, CraveLess.Me may provide notice by email, in-product message, or another reasonable method. Continued use of the Partner Listing service after updated terms become effective means the partner provider accepts the updated terms.

22. Standard legal terms

If any part of these Terms and Conditions is found to be invalid or unenforceable, the remaining parts will continue to apply. The partner provider may not assign or transfer their rights or obligations under these Terms and Conditions without CraveLess.Me’s prior written consent. CraveLess.Me may assign or transfer its rights and obligations as part of a business transfer, restructuring, sale, or similar transaction. Neither party is responsible for delay or failure to perform caused by events outside reasonable control, including technical outages, platform failures, payment provider issues, natural events, war, civil unrest, legal restrictions, or other force majeure events. These Terms and Conditions, together with any checkout terms, order confirmation, privacy policy, or written agreement that applies to the Partner Listing, form the entire agreement between the parties regarding the Partner Listing. If either party does not enforce a right immediately, that does not mean the right is waived. Notices may be sent by email, in-product message, or another reasonable method using the contact details provided by the relevant party. If these Terms and Conditions are translated, the English version will control unless another language version is expressly stated to be legally controlling.

23. Governing law and jurisdiction

These Terms and Conditions should specify the governing law and jurisdiction that apply to the agreement. - Partner Listings and Promoted Placements may be clearly labelled as paid, promoted, sponsored, partner, or listed-provider placements. - CraveLess.Me does not sell user contact details to partner providers. - Partner providers receive user contact details only when a user chooses to contact them directly or submits an inquiry. - Any reporting shared with partners should be aggregate or non-identifying unless the user has directly contacted the partner provider. - In-app pop-up targeting is limited to schedule slippage and signup country to keep the experience privacy-conscious. - The first-year discount reflects that CraveLess.Me is still building the product, partner directory, in-app placement experience, and user base.
